The Decree establishing the National Mining Agency (ANM) and approving its organizational structure and table of commissioned positions was published today (28th) in the Official Gazette of the Union (DOU). The ANM will begin exercising its powers next Wednesday (12/05/2018).
The ANM takes over the functions previously performed by the DNPM (National Department of Mineral Production), absorbing the activities already carried out by that body and exercising new powers, with the aim of providing an environment of stability and predictability regarding government acts in the management of mining rights. The ANM’s management will seek greater transparency in regulatory actions concerning mining and ensure that decisions are always based on technical principles and industry best practices.
The Collegiate Board will consist of a director-general and four directors with terms ranging from two to four years. The members were also appointed in today’s DOU:
Director-General, Victor Hugo Froner Bicca, with a four-year term;
Director, Debora Toci Puccini, with a three-year term;
Director, Tomás Antônio Albuquerque, with a two-year term;
Director, Tasso Mendonça, with a three-year term;
Director, Eduardo Araujo de Souza, with a four-year term.
The ANM director-general must publish, within 60 days, a list of the holders of commissioned positions and the number of vacant positions.
The new Regulation of the Mining Code, established by Decree No. 9,406/18, previously enacted by President Temer, will also enter into force on December 5, 2018.
